Nevada’s Modified Business Tax: The Employer Tax in a No-Income-Tax State

Nevada is famous for having no state income tax, which leads some employers to assume there is little to do on the state side. But Nevada does levy an employer payroll tax — the Modified Business Tax (MBT) — and it works differently from most. Here is what to know.

A quarterly tax with a threshold

Unlike a per-paycheck payroll tax, MBT is assessed quarterly on total gross wages above a $50,000-per-quarter exemption. In other words, an employer pays nothing on the first $50,000 of wages each quarter and the tax rate only on the excess. Because the exemption is measured over the whole quarter, the amount is really only known at quarter-end.

The rates

For general businesses the rate is 1.17% on the wages above the quarterly exemption. Financial institutions and mining companies pay a higher rate — 1.554% — and are treated differently on the exemption. Employers can also subtract qualifying employer-paid health insurance premiums from the wage base before applying the rate.

MBT is entirely the employer’s tax. Nothing is withheld from the employee.

How it is filed

MBT is filed and paid quarterly with the Nevada Department of Taxation, separately from the unemployment contributions that go to Nevada’s employment agency. Employers are typically enrolled for it alongside their state unemployment account.
